These Terms & Conditions (the "Terms") govern your access to and use of this website, benacoadjusters.com (the "Site"), which is owned and operated by Benaco Adjusters LLC ("Benaco," "we," "us," or "our").
By accessing, browsing, or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
These Terms apply to all visitors and users of the Site, including users who contact us through the Site or submit information to join our adjuster roster. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization and you accept these Terms on its behalf.
The Site is provided for general informational and recruiting purposes. The Site is not intended to be used to report an insurance claim, provide notice of loss, or satisfy any policy, statutory, or contractual deadline. Do not rely on this Site to communicate time-sensitive claim information.
Information on the Site is not legal, tax, regulatory, or professional advice. Coverage determinations and claim decisions are made by the applicable insurer and/or other responsible parties—not by this Site content.
Benaco provides independent insurance adjusting and related claims services. Any professional services we perform are governed by separate written agreements (e.g., engagement letters, service agreements, vendor agreements, or independent contractor agreements). These Terms govern only your use of the Site.
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You must not:

The Site and all content on it—including text, graphics, logos, images, videos, design, software, and other materials (collectively, "Content")—are owned by Benaco or our licensors and are protected by intellectual property laws.
Subject to these Terms, Benaco grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and Content for your personal, informational, and non-commercial use. You may not copy, reproduce, modify, distribute, publish, publicly display, create derivative works from, sell, or exploit the Site or Content without our prior written permission.
The Site may allow you to submit information (for example, through contact forms or an adjuster roster application) ("Submissions").
You represent and warrant that your Submissions are accurate, complete, and not misleading, and that you have all rights necessary to provide the Submissions to us.
Do not submit sensitive personal information through the Site unless specifically requested (e.g., Social Security numbers, payment card information, or medical information). If you choose to submit such information, you do so at your own risk.
You grant Benaco a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process your Submissions for legitimate business purposes related to your request (e.g., responding to inquiries, evaluating roster applications, recruiting, compliance, and operational communications), subject to our Privacy Policy.
Submitting a roster application does not guarantee engagement, deployment, assignment, employment, or any contract. Benaco may accept or reject applications in its sole discretion and may request additional information, verification, references, background checks (where permitted by law), licensing documentation, and/or onboarding documentation.
The Site may reference or link to third-party websites, services, or content. We do not control third-party sites and are not responsible for their content, policies, availability, or practices. Links are provided for convenience and do not imply endorsement. Your use of third-party sites is at your own risk and subject to the third party's terms and policies.
Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated by reference into these Terms. Please review it to understand our practices.
THE SITE AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENACO DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that Content will be accurate, complete, current, or reliable.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BENACO (OR ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENACO'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED US $100.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY. IN SUCH CASES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY.
You agree to defend, indemnify, and hold harmless Benaco and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your Submissions, or your violation of these Terms.
We may update these Terms from time to time. Changes are effective when posted on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Juan, Puerto Rico, and you consent to the personal jurisdiction of those courts.
